1. Working with children
1.1 All employees, contractors, volunteers, sub-contractors and directors of Bright Stars hold a valid Working with Children Check, as required by relevant legislation.
2. Photography and media
2.1 Bright Stars does not photograph, film, or otherwise record children during class as a matter of policy.
2.2 We do not use images, video, or footage of enrolled children in our marketing, website, or promotional material. If we would like to feature your child in marketing material on a particular occasion, we will ask you separately and will only proceed if you sign a specific consent form for that purpose.
3. Consent, supervision and liability
3.1 Dance is a physical activity, and a teacher or teaching assistant may need to assist your child's understanding of an action, posture or position through physical contact — for example, holding hands in a circle, lifting, or correcting posture. By enrolling, you consent to employees, contractors, sub-contractors and directors of Bright Stars having this kind of contact with your child.
3.2 Any dance class or performance carries some risk of personal injury. While we take all reasonable care in the conduct of our classes, we don't accept responsibility for injury or loss during classes except as set out in this section. You're responsible for ensuring your child is physically and medically fit to take part, and for telling us about any medical conditions, injuries or allergies affecting your child at enrolment or as they arise.
3.3 To the extent permitted by law, and except as set out in this section, we exclude liability for claims, loss, damage, cost or expense you incur in connection with your or your child's use of our services, and we exclude all representations and warranties except those that cannot be excluded under the Australian Consumer Law (ACL). Our services come with guarantees that can't be excluded under the ACL. For a major failure, you may be entitled to a refund, compensation, or the reduced value of the service; for a minor failure, we may choose to provide a refund or re-supply the service. To claim compensation you'll need to provide documentary evidence of the loss and that it was a reasonably foreseeable result of our failure to meet a consumer guarantee (for example, photographs, statutory declarations, or a doctor's report, depending on the situation). To the extent permitted by law, we won't be liable for indirect or consequential loss connected to our contract with you, in contract, negligence or otherwise, unless that loss results from our own negligence or wilful misconduct. Our liability is reduced to the extent you cause or contribute to the loss or damage, whether in contract, negligence or otherwise.
4. Health, safety and emergency procedures
4.1 In a medical emergency, you understand that a teacher may seek medical attention for your child, or call an ambulance, if considered necessary. Any costs associated with this are at your expense.
5. Enrolment, fees and direct debit payments
5.1 Fees for your child's program are collected by direct debit through our payment provider. When you complete enrolment and authorise the direct debit, you're agreeing to the fee amount, frequency (per term, unless stated otherwise) and start date shown to you at checkout.
5.2 We don't collect or store your bank account or card details ourselves — these are held securely by our payment provider.
5.3 If a scheduled direct debit is declined or fails, we'll let you know and may attempt to process it again. We'll always tell you before re-attempting a payment, and we won't add our own fee on top of whatever (if anything) our payment provider charges for a failed transaction.
5.4 To change or cancel your direct debit arrangement, contact us at info@plum-jay-202661.hostingersite.com or 0490 260 410, giving at least 7 days' notice before the next scheduled debit wherever possible.
6. Refunds, credits, cancellations and withdrawals
6.1 If you need to withdraw your child partway through a term — whether that's relocation, holidays, illness, or simply a change of circumstances — contact us and we'll provide a refund or credit for any lessons in that term that haven't yet been delivered, calculated from the date you let us know. You don't need to give a reason.
6.2 We don't provide refunds for lessons that have already been delivered, or for lessons missed without notice, except where the Australian Consumer Law requires otherwise (see 6.4).
6.3 Refunds are returned to the payment method used for the original direct debit, normally within 5 business days of your request being confirmed.
6.4 Nothing in this section limits or excludes any right you have under the Australian Consumer Law. If our services fail to meet a consumer guarantee, you may be entitled to a refund, re-supply, or compensation as described in Section 3.3, regardless of the policy set out above.
7. Privacy and personal information
7.1 We collect personal information about you and your child — including contact details, date of birth, and health-related information such as allergies or medical needs — so we can deliver our programs safely and communicate with you.
7.2 We don't sell your personal information. We share it only with the people who need it to run the program: your child's teacher, the centre or school hosting the class, and our payment provider for billing purposes.
7.3 We store your information securely and keep it only for as long as it's needed for the purpose it was collected, or as required by law.
7.4 You can ask us to access, correct, or delete the personal information we hold about you or your child at any time by contacting info@plum-jay-202661.hostingersite.com.
7.5 We handle personal information in a way consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
8. Communications and newsletter
8.1 Enrolling your child in a Bright Stars program adds you to our weekly lesson recap email. You can unsubscribe at any time using the link at the bottom of any email.
9. Changes to these terms
9.1 We may update these terms from time to time, for example to reflect a change in our payment provider or services. We'll post the current version on this page, and material changes affecting existing enrolments will be communicated to you directly before they take effect.
